We have extensive experience representing clients in contract surety matters. Among the areas we provide assistance and representation to our clients are investigating defaulting principals and obligees, assessing performance and payment bond claims, helping clients to determine whether to finance or complete a project, tender a defense, and identifying and asserting appropriate defenses.
Our contract surety services often involve the negotiation and drafting of takeover agreements, completion contacts, and financing agreements. Our attorneys regularly handle Miller Act and Little Miller Act litigation, among other statutory claims and causes of action. Our attorneys have also represented “start-up” surety operations. In that capacity, we have dealt with licensing and regulatory issues, drafting necessary documents (e.g., indemnity agreements, bond forms, collateral agreements and receipts, etc.), and assisting in assembling and training claims departments.
